Man taken into custody for drug and possible theft charge

Police in Texas say that two people were taken into custody at a mechanic shop in Henderson County. This occurred after police searched the business on April 9. A 47-year-old man faces a charge of manufacture and delivery of a controlled substance totaling more than four grams but less than 200 grams. Police said that there was a Harley Davidson motorcycle at the shop that had been reported stolen in 2015.

According to authorities, the man could face additional charges related to the theft. The bike was discovered in addition to what authorities thought to be methamphetamine that was going to be sold. He was being held in Henderson County Jail on a $12,500 bond. Another person was also taken into custody after the search. She was wanted on a misdemeanor warrant in Nueces County.

If convicted on a drug charge, a person could be sentenced to jail time in addition to probation and a fine. However, having the assistance of an attorney may help an individual avoid some or all of the serious consequences a person may face after being convicted. For instance, legal counsel could move to have the charge dismissed before a trial begins. This could be done by having evidence suppressed or questioning if there was probable cause to take a person into custody at all.

In the event that a case does go to trial, a criminal law professional could cast doubt on physical evidence or testimony offered by police or other witnesses. For example, it may be possible to assert that a defendant was not in possession of a controlled substance or had no intent to sell or distribute it to others. Alternatively, legal counsel could contend that an individual was compelled or tricked to into buying, possessing or selling a controlled substance.
