Penalties Increase With the Amount of Marijuana You Possess
The amount of marijuana you are accused of possessing plays a large part in determining the charge and penalties you will face. The differences between penalties for possession and possession with intent to distribute are significant.
If you are arrested with four ounces to five pounds of marijuana, you can be sentenced to up to two years in prison. However, more than five pounds of marijuana can send you to prison for up to 10 years.
If you are convicted of a federal marijuana crime, you may face the following penalties:
- A prison term of five years or less for 50 kilograms or less of marijuana or 1 to 49 marijuana plants
- A five- to 40-year prison term for 100 kilograms or more of marijuana or 100 to 999 marijuana plants
- A prison term from 10 years to life for 1,000 kilograms or more of a mixture or substance containing marijuana or 1,000 or more marijuana plants
- A 20-year minimum mandatory prison term after one prior felony drug conviction
- A mandatory life term of imprisonment after two or more prior felony drug convictions
In addition, if you are sentenced to prison in a federal drug crime, you must serve a minimum of 85 percent of your sentence. You will also face steep fines, ranging from $250,000 to $4 million.
